- Dubai rent increases on renewal are capped by the official DLD Rental Index and Decree No. (43) of 2013, not by advertised market rents alone.
- A landlord seeking to amend rent or other renewal terms must generally give at least 90 days’ notice before expiry, unless the contract validly provides otherwise.
- For January 2027 expiries, the notice deadline falls in October or early November 2026 depending on the exact expiry date.

Smart Index Rent Limits: What a January Increase Can—and Cannot—Do
For Dubai tenancy contracts expiring in January, the key question is not simply whether market rents have moved. The legal question is whether the proposed increase is permitted by the official Dubai Land Department rental index framework and the rent increase caps under Decree No. (43) of 2013.
The permitted increase is calculated by comparing the tenant’s current annual rent with the applicable average rental value of similar units, then applying the statutory cap. The scale is:
- Current rent up to 10% below the average rental value: 0% increase.
- Current rent 11% to 20% below the average rental value: maximum 5% increase.
- Current rent 21% to 30% below the average rental value: maximum 10% increase.
- Current rent 31% to 40% below the average rental value: maximum 15% increase.
- Current rent more than 40% below the average rental value: maximum 20% increase.
The DLD’s Rental Index service allows users to calculate the rental increase and average rental value by entering the required tenancy and property details. A demand to “match the market” is therefore not enough if the official index and statutory cap do not support it.
The 90-Day Notice Rule: Timing Can Defeat the Rent Hike
Under Article 14 of Dubai Law No. (26) of 2007, as amended by Law No. (33) of 2008, a party wishing to amend the tenancy terms on renewal must notify the other party at least 90 days before the tenancy contract expiry date, unless otherwise agreed by the parties.
For January 2027 renewals, this can be decisive. If the contract expires on 1 January 2027, the 90-day deadline falls on 3 October 2026. If the contract expires on 31 January 2027, the 90-day deadline falls on 2 November 2026. A December 2026 rent increase notice will generally be too late for a January 2027 renewal.
The same amended law defines notice as written notification served through a Notary Public, registered mail, hand delivery, or another technological means approved by law. Informal, verbal or unsupported communications can therefore create avoidable disputes.
When a Rent Increase Notice Is Vulnerable
A proposed January renewal increase may be challengeable where the landlord did not comply with the notice requirement, the official index does not support the increase, or the demanded percentage exceeds the statutory cap.
Parties should check three points before accepting a new rent figure:
- Was the increase notified at least 90 days before expiry, unless the contract validly provides otherwise?
- Does the official DLD Rental Index or Smart Rental Index result permit an increase for the specific property and renewal date?
- Is the demanded percentage within the Decree No. (43) of 2013 cap?
Dubai Land Department guidance on the Smart Rent Index is consistent with this approach: the increase depends on both eligibility under the index and timely notice. Where either element is missing, the proposed increase may be contested, subject to the contract and the facts.
RDC Dispute Strategy: Prepare Before You File
If negotiation fails, the matter may proceed before the Rental Disputes Center, the specialised forum established under Decree No. (26) of 2013 for rental disputes in Dubai. The strongest cases are usually built before filing, not after.
Tenants and landlords should organise the tenancy contract, Ejari certificate, payment records, cheques, bank transfers, receipts, emails, WhatsApp messages, formal notices, DLD index results, DEWA or cooling bills, inspection records and any renewal correspondence. RDC service guidance also refers to supporting documents and Arabic or legally translated documents for online filing.
Where a landlord refuses to accept rent or renewal cheques while the increase is disputed, tenants should seek advice before withholding payment. The RDC’s Offer and Deposit service may be relevant in appropriate cases, without prejudice to leasehold rights.

Landlords should issue timely, written and properly evidenced notices, supported by the official index result and limited to the statutory cap. Tenants should respond promptly in writing, state any objections clearly, and preserve the full renewal record.
For January renewals, delay can change the legal position. A rent increase that might be valid in amount can still fail if it was notified late. Equally, a timely notice can still be challenged if the DLD index and Decree No. (43) of 2013 do not support the demanded increase.
